Disclaimer and Return Policy. This agreement sets forth rights and obligations as a User of Provider’s website and materials.
1. PERSONAL INFORMATION COLLECTION AND USAGEThe Provider collects information from the User when placing an order, subscribes to a newsletter, fills out a form, or enters information on the Provider’s site. When ordering or registering on the Provider’s site, as appropriate, the User may be asked to enter a username, email address, credit card information or other details to help the User improve their experience.
2. USE OF INFORMATIONThe Provider may use the information collected from the User when registering, making a purchase, signing up for a newsletter, responding to a survey or marketing communication, browsing a website, or when using certain other site features in the following ways:
• To personalize the experience and to allow the Provider to deliver the type of content and service offerings in which the User is most interested.
• To improve website(s) in order to better serve the User.
• To allow better service when responding to the User’s customer service requests.

3. PROTECTION OF INFORMATION Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make the User’s visit(s) to the Provider’s site(s) as safe as possible. The Provider uses regular malware scanning. The Provider may or may not use an SSL certificate because of third-party processors.
4. COOKIE USAGECookies are small files that a site or its service provider transfers to the User’s computer’s hard drive through the web browser, if permitted, that enables the site’s or service systems to recognize the User’s browser and capture and remember certain information. The Provider also uses cookies to help compile aggregate data about site traffic and site interaction to offer better site experiences and tools in the future, such as:
• To help remember and process the items in the User's shopping cart.
• To understand and save the User’s preferences for future visits.
• To keep track of advertisements.
• To compile aggregate data about site traffic and site interactions in order to offer better site experiences and tools in the future. Provider may also use trusted third-party services that track this information on the Provider’s behalf.
The User can choose to have their computer show a warning each time a cookie is being sent, or to turn off all cookies through their browser settings (e.g. Google Chrome, Apple Safari, Mozilla Firefox, Microsoft Edge). Each browser is a little different, so look at the browser’s Help menu to learn the correct way to modify cookies. If the User turns cookies off, some features will be disabled and the experience may be affected and some services may not function properly; however, the User can still checkout successfully.
5. DISCLOSURE OF INFORMATIONThe Provider does not sell, trade, or otherwise transfer to public parties the User’s name or any online contact identifiers, such as: email, name, cookie number, IP address, unique device identifier, PII, etc.
6. THIRD-PARTY LINKSOccasionally, at the Provider’s discretion, communications may include or offer third-party products or services. These third-party sites have separate and independent privacy policies. Therefore, the Provider has no responsibility and provides no liability for the content and activities of any linked sites. Nonetheless, the Provider seeks to protect the integrity of the materials offered and welcome any feedback about these sites.
7. GOOGLE’S ADVERTISING POLICYThe Provider uses Google AdSense Advertising. Google, as a third-party vendor, uses cookies to serve ads on the Provider’s site. Google’s use of the DART cookie enables it to serve ads to users based on their visit to sites on the Internet. The User may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy. The Provider has implemented the following:
• Remarketing with Google AdSense
• Google Display Network Impression Reporting
• Demographics and Interests Reporting
• DoubleClick Platform Integration
The Provider, along with third-party vendors, such as Google use first-party cookies, such as the Google Analytics cookies, and third-party cookies, such as the DoubleClick cookie, or other third-party identifiers together to compile data regarding User interactions with ad impressions, and other ad service functions as they relate to the Provider’s website. Opting Out: Users can set preferences for how Google advertises using the Google Ad Settings page. Alternatively, the User can opt out by visiting the Network Advertising Initiative opt-out page or permanently using the Google Analytics Opt-Out browser add-on.
8. DO NOT TRACK SIGNALSThe Provider honors Do Not Track (DNT) signals and does not track, plant cookies, or use advertising when a DNT mechanism is in place.
9. BEHAVIORAL TRACKINGThe Provider does not allow third-party behavioral tracking, except where used for advertising purposes.
10. CHILDREN ONLINE PRIVACY PROTECTIONThe Provider does not specifically market to children under 18.
11. FAIR INFORMATION PRACTICESPer Fair Information Practices principles the Provider will take the following responsive action, should a data breach occur: The Provider will notify the User via email within 180 business days via in-site notification. The Provider does not agree to an individual redress principle and the User understands and agrees to this.
12. CAN-SPAMIn accordance with CAN-SPAM rules the Provider always attempts to adhere to the following:
• To not use false, or misleading subjects or email addresses.
• To identify the message as an advertisement in some reasonable way.
• To include the physical address of Provider’s business or site headquarters.
• To monitor third-party email marketing services for compliance, if one is used.
• To honor opt-out/unsubscribe requests quickly.
• To allow User to unsubscribe by using the link at the bottom of each email.
13. EMAIL ADDRESS COLLECTION PURPOSES Reasons to collect an email address, include, but are not limited to the following:
• To send information, respond to inquiries, and/or other requests or questions.
• To process orders and to send information and updates pertaining to orders.
• To send additional information related to the User’s product and/or service.
• To market to a mailing list or continue to send emails to clients after the original transaction has occurred.
14. EUROPEAN UNION RIGHTS If the User is a citizen or a resident of a country in the European Union, they are granted the following additional rights:
• ACCESS TO PERSONAL DATA. The User has the right to receive a copy of their personal data that is subject to processing by the Provider. Ordinary requests will be granted without charge to the User within thirty (30) days from when a request is initiated. In cases of excessive, unreasonable, or repeated requests the Provider may charge a reasonable fee and may require additional time to grant the request. Also, the Provider may use reasonable means to confirm the User’s identity before granting any request regarding data so as to prevent granting fraudulent requests. • DATA CORRECTION. If the personal data is erroneous or outdated, the User has the right to have it corrected by contacting the Provider.
RIGHT TO BE FORGOTTEN. The User has the right to be forgotten and may exercise this right by contacting the Provider via the contact form. The account will be deleted, along with all personally-identifiable data that is subject to processing. After the request is completed the User will lose access to all products and services.
• TO RESTRICT PROCESSING OF DATA. The User can request that the User’s data not be processed via the Provider’s partners. Be advised that some partners are essential to the Provider’s services, and blocking these partners may render certain services unavailable to the User.
• PORTABILITY. The User has the right to receive a copy of the personal data that is subject to processing by the Provider in a portable format or to have it transferred directly from the Provider to another party.
15. NOTICESYou must
email team [AT] lambergg any request. The request was not acknowledged if you did not receive confirmation within (48) hours. It is the consumer's responsibility to ensure that all requests are correctly received and acknowledged. You may also mail your request to Lambergg, 401 East 8th Street, Sioux Falls, South Dakota 57103. All written communications must be sent via registered or certificated USPS mail only. The Provider is not responsible for late submissions, lost communications, or incomplete requests.
